Terms of Service

Effective date: August 7, 2026

These Terms of Service ("Terms") govern your access to and use of the FedM8 AI websites and applications, including ai.fedm8.com and scan.fedm8.com (the "Service"), operated by FedM8 ("FedM8," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

FedM8 AI provides tools built on public government data — including market dashboards, opportunity search, award history, guided walkthroughs, a veteran business directory, and AI-assisted analysis. The Service is an information and productivity tool. It does not submit bids for you, does not guarantee contract awards, and is not affiliated with, endorsed by, or sponsored by the U.S. Government, SAM.gov, or any federal agency.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly through the support form of any unauthorized use.

4. Government data; no guarantee of accuracy

The Service displays and analyzes data from public sources, including SAM.gov and USAspending.gov. That data is published by third parties and may be incomplete, delayed, or inaccurate, and we do not control it. Solicitation documents, deadlines, and requirements on official government systems always control. You are responsible for verifying every date, requirement, and figure against the official solicitation before relying on it.

5. AI features

AI-generated outputs (summaries, win briefs, fit assessments, drafts) are produced by machine learning models and may contain errors or omissions. They are provided as drafting and research assistance only. They are not legal, financial, or professional advice; they are not a promise of contract award; and they must be reviewed by you before use in any bid or business decision. We are not responsible for actions you take in reliance on AI outputs.

6. No professional advice

Content in the Service — including guides, walkthroughs, Bid Coach, and Academy lessons — is general educational information, not legal, accounting, or professional advice. Consult a qualified professional for advice on your specific situation. Always follow the solicitation and applicable FAR/agency rules that govern your bid.

7. Acceptable use

You agree not to: (a) use the Service in violation of law or third-party rights; (b) scrape, harvest, or bulk-export Directory members' contact information; (c) probe, disrupt, or circumvent security or access controls, rate limits, or plan gates; (d) resell, sublicense, or provide the Service to third parties as a service bureau without our written consent; (e) upload malicious code; (f) misrepresent your identity, certifications, or business status, including set-aside eligibility; or (g) use the Service to send spam or unsolicited communications. We may suspend or terminate accounts that violate this section.

8. Your content and the Veteran Directory

You retain ownership of the information you submit. You grant FedM8 a non-exclusive, worldwide, royalty-free license to host, display, and process that information as needed to operate the Service. Directory fields you mark visible are shown to other users by design; you can change visibility or remove your listing at any time. You are responsible for the accuracy of your listing, including any certification claims.

9. Intellectual property

The Service, including its software, design, and content (excluding government data and your content), is owned by FedM8 or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms.

10. Third-party services

The Service integrates third-party services (such as Stripe for payments and OAuth sign-in providers) and links to external sites, including official .gov sites. Your use of third-party services is governed by their terms, and we are not responsible for them.

11. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will provide reasonable notice and, for discontinued paid features, a prorated refund of prepaid amounts). Sections 4, 5, 6, 9, and 12–15 survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEDM8 AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES (INCLUDING LOST BIDS OR CONTRACT AWARDS), ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You will defend, indemnify, and hold harmless FedM8 from and against claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service in violation of these Terms, or your violation of law or third-party rights — including misrepresentation of certification or set-aside status in a bid or Directory listing.

15. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us through the support form and give us 30 days to work toward an informal resolution. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date, and where required we will provide additional notice (such as email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance.
